Terms of Service

Notice: This Terms of Service document is provided as a template and is intended to serve as a starting point. Estate Lookout makes no representations that this document is legally sufficient for all use cases or jurisdictions.

1. Acceptance of Terms

By accessing or using the Estate Lookout platform ("Service"), including our website at estatelookout.com and all associated subdomains, you ("User," "You," or "Your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

You must be at least 18 years of age to create an account or use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

2. Description of Service

Estate Lookout is a software-as-a-service ("SaaS") platform designed for home watch and property monitoring businesses. The Service provides tools for managing clients, properties, visit scheduling, photo documentation, report generation, invoicing, quoting, and client communication.

The Service is a management tool only. Estate Lookout does not perform home watch or property monitoring services directly. Each business using the platform ("Tenant") is solely responsible for the quality, accuracy, and legality of the services they provide to their own clients.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately of any unauthorized use of your account.

You are responsible for all activity that occurs under your account. Estate Lookout is not liable for any loss or damage arising from your failure to safeguard your login credentials.

If you are an organization administrator ("Org Admin"), you are responsible for the actions of all users you invite to your organization, including employees and clients.

4. Acceptable Use Policy

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Upload, transmit, or store any content that is harmful, abusive, defamatory, obscene, or otherwise objectionable
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or systems connected to the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to store or transmit malicious code, viruses, or any other harmful technology
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute access to the Service without prior written consent

5. Tenant Responsibilities

Each Tenant (business organization using the Service) is solely responsible for:

  • The accuracy and completeness of all data entered into the platform, including client information, property details, visit records, and reports
  • Compliance with all applicable laws, regulations, and industry standards related to their home watch or property monitoring business, including but not limited to licensing requirements, insurance obligations, and consumer protection laws
  • Their relationships with their own clients, including the handling of disputes, complaints, and service quality issues
  • Obtaining all necessary consents from their clients before entering personal information into the platform
  • Maintaining appropriate business insurance, including general liability, errors and omissions, and any other coverage required by law or industry best practice

Estate Lookout has no responsibility or liability for the actions, omissions, or service quality of any Tenant.

6. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by Estate Lookout and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during the term of your subscription.

You retain ownership of all content you upload to the Service, including photos, reports, client data, and other materials. By uploading content, you grant Estate Lookout a limited license to host, store, and transmit that content solely to provide the Service to you.

7. Payment and Billing

Paid subscription plans are billed in advance on a monthly or annual basis. Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods, except as required by applicable law.

We reserve the right to modify pricing with 30 days' advance notice. Price changes will take effect at the start of your next billing cycle.

8. Data Handling and Security

We take the security of your data seriously. All personally identifiable information ("PII") is encrypted at rest using AES-256-GCM encryption. All data in transit is protected by TLS encryption. Access to data is controlled through row-level security policies ensuring strict multi-tenant isolation.

However, no method of electronic transmission or storage is 100% secure. While we strive to use commercially acceptable means to protect your data, we cannot guarantee its absolute security. You acknowledge and accept this inherent risk.

9. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Estate Lookout does not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

The Service is not a substitute for professional property monitoring, security systems, insurance, or legal compliance. You should not rely on the Service as your sole means of property protection or documentation.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ESTATE LOOKOUT, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  • ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING BUT NOT LIMITED TO REPORTS, DATA EXPORTS, OR GENERATED DOCUMENTS
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
  • ANY PROPERTY DAMAGE, LOSS, THEFT, OR HARM THAT OCCURS TO PROPERTIES MONITORED THROUGH THE SERVICE

IN NO EVENT SHALL ESTATE LOOKOUT'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ESTATE LOOKOUT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the above limitations shall apply to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Estate Lookout, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including any intellectual property, privacy, or other proprietary right
  • Any claim that your content or actions caused damage to a third party
  • Any claim arising from the home watch, property monitoring, or related services you provide to your own clients

12. Termination and Data Deletion

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination:

  • Your subscription will be cancelled at the end of the current billing period
  • You may request an export of your data before account closure
  • Your data will be retained for 30 days after termination to allow for recovery in case of accidental deletion, after which it will be permanently purged
  • Photos and files stored in cloud storage will be deleted as part of the data purge process

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in the State of Colorado for the resolution of any disputes.

14. Dispute Resolution

Before filing any formal legal claim, you agree to first contact us at legal@estatelookout.com and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved within that period, either party may pursue formal legal action.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

16. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Estate Lookout regarding your use of the Service, and supersede any prior agreements.
